Terms of Service

Effective Date: September 1, 2025


1. Acceptance of Terms

By accessing or using the services of The PHat Chef (“Company,” “we,” “our,” or “us”), including but not limited to meal preparation, cooking classes, private dining, and event chef services (the “Services”), you (“Client,” “User,” or “you”) agree to be bound by these Terms of Service (“Terms”). If you do not agree, you must not use the Services.


2. Services

The Company operates as a chef agency, assigning vetted chefs to provide in-home cooking, meal preparation, and related services. The Company is not a marketplace and does not permit direct contracting between chefs and clients outside the platform.


3. Accounts and Eligibility

  • Users must create an account to book Services.

  • Users under the age of 18 must obtain parental or guardian consent.

  • The Company reserves the right to suspend or terminate accounts in cases of misuse, non-payment, or breach of these Terms.


4. Bookings, Payments, and Refunds

  • Payments must be made through Company-approved methods (GCash, BDO, BPI)

  • Payments are processed by the Company and not directly by chefs.

  • Clients may reschedule bookings up to 72 hours before service without penalty.

  • Rescheduling within 72 hours of service may incur a ₱500 rebooking fee, subject to chef availability.

  • Cancellations more than 72 hours before service are eligible for a full refund.

  • Cancellations within 72 hours are non-refundable.


5. Client Responsibilities

  • Clients are responsible for providing a safe and suitable kitchen environment.

  • Clients are responsible for groceries unless grocery assistance is requested.

  • Clients must not request services beyond the agreed booking scope.


6. Chef Responsibilities

  • Chefs are required to arrive on time, prepare meals as agreed, and perform reasonable kitchen clean-up.

  • Chefs are not responsible for dishwashing, household chores, or services beyond those agreed upon in the booking.


7. Prohibited Uses

You agree not to:

  • Misuse the Services or engage in fraudulent bookings.

  • Harass, abuse, or exploit chefs or other users.

  • Circumvent payments by contracting chefs outside the platform.

  • Request services beyond the agreed booking.


8. Suspension and Termination

The Company may suspend or terminate access to the Services, without liability, if you:

  • Fail to make payments,

  • Misuse the Services,

  • Violate these Terms.


9. Limitation of Liability

  • The Company is not liable for injuries, accidents, food allergies, or damages arising from Services performed by chefs.

  • Services are provided “as is” without warranties of any kind.

  • To the maximum extent permitted by law, the Company’s liability shall not exceed the total amount paid by the Client for the disputed booking.


10. Dispute Resolution

  • Parties shall first attempt to resolve disputes informally by contacting thephatchef.ph@gmail.com.

  • If unresolved, disputes shall be submitted to mediation administered in Quezon City, Philippines.

  • If mediation fails, disputes shall be resolved by binding arbitration under Philippine law, conducted in Quezon City.

  • Only if arbitration is not possible shall disputes be submitted to the courts of Quezon City, Philippines.


11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines.


12. Amendments

The Company may amend these Terms at any time. Continued use of the Services constitutes acceptance of revised Terms.
